General terms and conditions

These general terms and conditions apply to all contracts between Ingo Schmidt-Lucas, trading under the brands Cybele AV Studios, Cybele Records and hd-klassik (hereinafter “the Provider”), and his customers concerning services in the field of audio and video production, mastering, post-production and the manufacture of sound carriers (CD pressings, for example).

§ 1 Scope and provider

These terms and conditions apply to all services of the Provider towards consumers and businesses, unless otherwise agreed in writing.

§ 2 Description of services

The Provider offers services in the following fields:

  • sound and music recording (in the studio or on location)
  • audiovisual recordings (concert recordings, for example)
  • post-production, mastering, editing
  • production of CD masters and CD pressings on behalf of the customer

These are individually rendered services.

§ 3 Conclusion of contract

A contract for a service is concluded by individual agreement by email, by telephone or in person. Offers are without obligation. A binding contract comes into being only upon acceptance (written confirmation or commencement of performance, for example).

§ 4 Customer’s duty to cooperate

The customer undertakes to provide in good time all information, materials, works and rights necessary to carry out the order.

§ 5 Prices and terms of payment

All prices are net prices plus statutory value added tax (unless the small business rule applies). Payments are due without deduction within 14 days of invoicing. The prices agreed in the individual offer apply.

§ 6 Performance and delivery terms

Dates of performance are agreed individually. In the case of audio or audiovisual carrier pressings, physical delivery is handled by commissioned service providers. Risk passes upon handover to the customer or to the carrier.

§ 7 Copyright and rights of use

The Provider remains the holder of all copyright in his own creative work unless otherwise agreed. The customer receives a simple right of use for the agreed purpose. Any transfer or modification requires prior consent.

§ 8 Liability

The Provider is liable only in cases of intent and gross negligence. Liability for indirect damage, consequential damage or loss of profit is excluded. This does not apply to injury to life, body or health.

§ 9 Data protection

Personal data is processed solely for the performance of the contract and in accordance with the General Data Protection Regulation (GDPR). Further information can be found in the privacy policy.

§ 10 Final provisions

German law applies. The place of jurisdiction is the Provider’s registered office, provided the customer is a merchant. Should any provision of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected.
